Abstract
Las medidas cautelares penales personales, se proyectan sobre la persona del imputado con el fin de asegurar su sujeción al proceso penal y la efectividad de la sentencia condenatoria que eventualmente pudiese recaer en éste. Las medidas cautelares también constituyen un instrumento de cooperación y lucha contra la criminalidad transfronteriza capital, como es el caso de la Orden de detención europea y los procedimientos de entrega entre los Estados Miembros.
La libertad personal es, después del derecho a la vida, el primero de los derechos, lo que llevó a que su protección se consignara ya en la Carta Magna inglesa de 1215. La importancia del derecho se refleja en el cuidado con el que el constituyente lo recogió y en su régimen de garantías, contando con una característica de este derecho, como es el procedimiento de habeas corpus.
