Abstract
A la vista de la investigación, se puede colegir que uno de los principales riesgos de la autorregulación, común a cualquier norma privada es que podría dar lugar a que se desarrolle y trivialice la práctica del 'self service', del 'pick and choose' normativo o, dicho en otras palabras, del Derecho a la carta; cuyo resultado podría ser que, mientras las obligaciones de las empresas transnacionales se muevan en los contornos de la impunidad o, en el mejor de los casos, desde la debilidad de las normas indicativas, sus derechos se tutelen desde la fortaleza jurídica de la Ley mercantil o del Derecho Internacional de las Inversiones.
Si se pone en relación los desastres ambientales sucedidos en la bahía de Portmán, en Bhopal o el del Prestige en la Costa da Morte con el reciente desastre ambiental provocado por la petrolera británica BP en el Golfo de México, se puede colegir que el daño ambiental ligado al binomio pobreza-riqueza de las naciones da como resultado una relación desigua...
