Libertad y derecho a la educación en España. El caso del pin parental murciano

Abstract

En este artículo se analizará la figura del pin parental, el cual fue implementado en España en la Región de Murcia en el año 2019. Esta medida permitía a los padres la potestad de autorizar la participación de sus hijos en actividades complementarias educacionales que se impartían en los centros educativos, particularmente aquellas relacionadas con la educación sexual. Se examinarán las implicaciones jurídicas del pin parental, especialmente desde la perspectiva constitucional y cómo afecta este al derecho a la educación. Se considerará como el derecho a la educación se contrapone con el derecho de los padres a educar a sus hijos de acuerdo a sus convicciones morales y religiosas. Se pondrá de relieve la problemática que existe entre estos derechos, abordando el examen de algunas figuras relevantes como es la objeción de conciencia, y señalando cuáles son las posiciones doctrinales y jurídicas al respecto. De este análisis se extraerán una serie de conclusiones que expondrán como ajustar el correcto equilibrio entre estos derechos.

This article will analyze the figure of the parental pin, which was implemented in Spain in the Region of Murcia in 2019. This measure allowed parents the power to authorize the participation of their children in complementary educational activities that were taught in educational centers, especially those related to sexual education. The legal implications of the parental pin will be examined, especially from the constitutional perspective and how it affects the right to education. In addition, the conflict between the right to education and the right of parents to educate their children according to their moral and religious convictions will be considered. The current problem that exists between these rights will be emphasized, addressing the examination of some relevant figures such as conscientious objection, and pointing out the doctrinal and legal positions in this regard. From the analysis, a series of conclusions will be drawn that will expose how to adjust a correct balance of these rights.
