La naturaleza entre realidad, percepción y abstracción: Algunas consideraciones sobre la experiencia jurídica romana

Abstract

En los últimos años, los investigadores han ido tomando conciencia de la necesidad de integrar en la noción de ecología no sólo las ciencias naturales, físicas y medioambientales, sino también las humanidades, tan necesarias para situar el estudio del espacio en su contexto temporal y, por tanto, propiamente humano. Este estudio pretende ofrecer una visión general de la idea de naturaleza en la experiencia jurídica romana a través de tres niveles distintos de interpretación. En primer lugar, la naturaleza como realidad, entendida como el conjunto de recursos naturales a disposición del hombre para su beneficio; en segundo lugar, la naturaleza como percepción, que alude a la dimensión cultural y, por tanto, al modo en que el hombre entendía la naturaleza en un momento histórico determinado; por último, la naturaleza como proceso de abstracción a través de las herramientas técnicas ofrecidas por la ciencia jurídica romana. Partiendo de esta premisa metodológica, sin ninguna pretensión de exhaustividad, intentaremos escribir algunas incompletas reflexiones sobre la idea de naturaleza en Roma que, a través del diálogo con la antropología, la filosofía y la religión, permitan tal vez una mejor comprensión del lugar ocupado por el hombre en el mundo antiguo.

In recent years, scholars have become increasingly aware of the need to integrate into the notion of ecology not only the natural, physical and environmental sciences, but also the humanities, which are so necessary to situate the study of space in its temporal and, therefore, properly human context. This study aims to provide an overview of the idea of nature in the Roman juridical experience through three different levels of interpretation. Firstly, nature as reality, understood as the set of natural resources available to man for his benefit; secondly, nature as perception, which alludes to the cultural dimension and, therefore, to the way in which man understood nature at a given historical moment; finally, nature as a process of abstraction through the technical tools offered by Roman legal science. Starting from this methodological premise, without any pretension of exhaustiveness, we will try to write some incomplete reflections on the idea of nature in Rome which, through dialogue with anthropology, philosophy and religion, will perhaps allow a better understanding of the place occupied by man in the ancient world.
